What Qualifies as an Industrial Design?
Under Indonesian Law (Law No. 31 of 2000), an Industrial Design is defined as a creation on the shape, configuration, or composition of lines or colors, or a combination thereof, in a three-dimensional or two-dimensional form which gives an aesthetic impression and can be realized in a 3D or 2D pattern and used to produce a product, commodity, or industrial handicraft.
Key Requirements:

  • Novelty: The design must be new. It should not be the same as any previous design that has been disclosed to the public anywhere in the world before the filing date (or priority date).
  • Non-Conflict: It must not contravene prevailing laws, public order, religion, or morality.

  • Exclusive Rights: You gain the sole right to use, sell, import, or distribute products embodying the design for 10 years from the filing date.

    The Registration Process: Step-by-Step

    The Directorate General of Intellectual Property (DGIP) handles all filings. The process typically follows these stages :

    1. Filing Submission of the application form, drawings/photos, and description.
    2. Administrative Exam DGIP checks for completeness of documents (usually within 30 days).
    3. Publication The design is published for 3 months. During this time, third parties may file oppositions.
    4. Substantive Exam If there is an opposition, a substantive examination is conducted. If no opposition occurs, the design moves toward grant.
    5. Grant & Certification Once approved, the DGIP issues the Industrial Design Certificate.
    Required Documents for International Applicants :
    Foreign applicants must file through a Registered Indonesian Intellectual Property Consultant. You will need to provide:
  • Power of Attorney: Signed by an authorized representative of your company.
  • Statement of Ownership: A declaration confirming you are the rightful creator/owner.
  • Design Representations: Clear drawings or photographs (Front, Back, Left, Right, Top, Bottom, and Perspective views).
  • Description of the Design: A brief explanation of the aesthetic features. Priority Document.
  • If you are claiming priority from a filing in another country (must be filed within 6 months of the original filing).
    Practical Tips for Success Mind the Grace Period: Indonesia offers a 6-month grace period. If your design was exhibited in an official international exhibition or used for research purposes, you can still file for protection within 6 months of that disclosure.
    • Conduct a Search First: Before filing, it is highly recommended to perform a search in the DGIP database to ensure your design doesn’t overlap with existing registrations.
    • Quality of Drawings: Ensure your drawings are high-resolution and clearly define the “novel” parts of the design. Vague images often lead to delays or rejections.
